compensation is a system of benefits for workers who suffer job-related
injuries or diseases paid by employers regardless of fault. In
exchange for these benefits, workers relinquish their right to
sue the employer for the tort of negligence.
What is Workers' Compensation
Insurance?
Workers' Compensation Insurance,
aka workers comp insurance, is a form of insurance paid for entirely
by the employer to provide the necessary funds to pay for workers'
comp. benefits. By law, no part of the workers' comp insurance
premium can be charged to the employee.
What are some of the benefits
provided by workers' compensation?
- Medical care: Costs that are required to treat the
employee for the effects of the injury.
- Permanent total disability: Monetary benefits for an employee
who becomes permanently disabled.
- Permanent partial disability: Benefits for a permanent disability
or disfigurement to an employee who can still work.
- Temporary total disability: Monetary benefits for the employee
while he/she is off work, recovering from the work related injury.
- Temporary partial disability: Benefits paid to the employee while
he/she is recovering from the work related injury, but working
on light duty.
- Vocational rehabilitation: If an injured worker is participating
in a vocational rehabilitation program which is approved, benefits
are provided.
- Death benefits: Paid to surviving family members.
